1. PENGENALAN

• RH Empire Legacy (“Empire Legacy”, “kami”, “pihak kami”, atau “syarikat”) menghormati dan komited dalam melindungi privasi, kerahsiaan, dan keselamatan semua pengguna, pelawat, prospek, klien, pelanggan, rakan niaga, serta mana-mana individu yang berinteraksi dengan servis, website, landing page, web application, sistem, platform digital, portal pelanggan, aplikasi mudah alih, serta perkhidmatan berkaitan yang disediakan oleh RH Empire Legacy.
• Dasar Privasi ini menerangkan bagaimana DATA PERIBADI dikumpul, digunakan, diproses, disimpan, dikongsi, dilindungi, dan diuruskan oleh RH Empire Legacy selaras dengan amalan industri yang munasabah serta keperluan undang-undang yang berkaitan termasuk tetapi tidak terhad kepada Akta Perlindungan Data Peribadi 2010 (PDPA) Malaysia.
• Dengan mengakses, melayari, menggunakan, mendaftar, menghubungi, menghantar maklumat, membuat pembayaran, mengisi borang, atau menggunakan mana-mana servis yang disediakan oleh RH Empire Legacy, pengguna dianggap telah membaca, memahami, dan bersetuju dengan Dasar Privasi ini.
• Sekiranya pengguna tidak bersetuju dengan mana-mana bahagian dalam Dasar Privasi ini, pengguna hendaklah menghentikan penggunaan servis dan platform kami dengan serta-merta.

2. TAFSIRAN & DEFINISI

Bagi tujuan Dasar Privasi ini, istilah berikut hendaklah membawa maksud seperti berikut:

• "DATA PERIBADI" merujuk kepada sebarang maklumat yang boleh mengenal pasti seseorang individu secara langsung atau tidak langsung.
• "Pengguna" merujuk kepada mana-mana individu, prospek, pelanggan, klien, pelawat, atau pihak yang berinteraksi dengan RH Empire Legacy.
• "Servis" merujuk kepada semua perkhidmatan yang ditawarkan oleh RH Empire Legacy termasuk tetapi tidak terhad kepada pembangunan website, landing page, web application, aplikasi mudah alih, sistem SaaS, automasi, pemasaran digital, penjenamaan, konsultasi digital, perkhidmatan hartanah, perancangan harta pusaka, perundingan kewangan, serta mana-mana servis berkaitan.
• "Pihak Ketiga" merujuk kepada mana-mana penyedia servis luar, penyedia teknologi, rakan strategik, penyedia infrastruktur, atau platform yang digunakan bagi menyokong operasi RH Empire Legacy.

3. MAKLUMAT YANG DIKUMPUL

• RH Empire Legacy boleh mengumpul pelbagai jenis maklumat bergantung kepada tujuan penggunaan servis, interaksi pengguna, dan keperluan operasi.
• Maklumat yang mungkin dikumpulkan termasuk tetapi tidak terhad kepada: Nama penuh, Nombor telefon, Alamat emel, Alamat surat-menyurat, Alamat premis atau perniagaan, Nombor Kad Pengenalan (MyKad), Nombor SSM, Maklumat syarikat atau organisasi, Jawatan atau kedudukan dalam organisasi, Maklumat pembayaran atau pengemabilan/pemulangan, Rekod komunikasi, Maklumat konsultasi, Maklumat berkaitan projek, Maklumat yang diberikan melalui borang atau saluran komunikasi rasmi.
• Dalam keadaan tertentu, RH Empire Legacy mungkin memerlukan maklumat tambahan bagi tujuan: Pengesahan identiti, Pematuhan undang-undang, Pengurusan projek, Dokumentasi kontrak, Urusan hartanah, Perancangan harta pusaka, Pengurusan risiko, Pencegahan penipuan, Tujuan perniagaan yang sah.
• Nombor Kad Pengenalan (MyKad) hanya akan dikumpulkan apabila diperlukan secara munasabah bagi tujuan pengesahan identiti, pematuhan undang-undang, dokumentasi rasmi, urusan hartanah, urusan harta pusaka, pengesahan pemilikan, atau tujuan lain yang dibenarkan oleh undang-undang.

4. MAKLUMAT TEKNIKAL & AUTOMATIK

• Apabila pengguna melayari atau menggunakan platform RH Empire Legacy, maklumat tertentu mungkin dikumpulkan secara automatik bagi tujuan keselamatan, analitik, prestasi sistem, dan penambahbaikan pengalaman pengguna.
• Maklumat tersebut mungkin termasuk: Alamat IP, Lokasi anggaran, Jenis peranti, Sistem operasi, Jenis browser, Bahasa peranti, Data penggunaan, Halaman yang dilawati, Tempoh lawatan, Sumber trafik, Data penukaran (conversion), Data interaksi pengguna, Rekod log sistem.
• Maklumat ini boleh dikumpulkan melalui penggunaan: Cookies, Google Analytics, Meta Pixel, TikTok Pixel, Heatmap Tools, Conversion Tracking, Sistem Automasi, Teknologi Analitik, Integrasi Pihak Ketiga.

5. TUJUAN PENGUMPULAN & PENGGUNAAN DATA

• RH Empire Legacy boleh menggunakan DATA PERIBADI yang dikumpulkan bagi tujuan termasuk tetapi tidak terhad kepada: Memberikan servis yang diminta oleh pengguna, Menyediakan quotation, invois, dan dokumentasi berkaitan, Mengurus projek dan pelaksanaan servis, Berkomunikasi dengan pengguna atau klien, Memberikan sokongan pelanggan, Menjalankan sesi konsultasi, Menyediakan laporan dan rekod transaksi, Memproses pembayaran, Menjalankan pengesahan identiti, Mencegah aktiviti penipuan, Mengurus risiko operasi, Menambah baik prestasi servis, Menambah baik pengalaman pengguna, Menjalankan aktiviti pemasaran yang sah, Menghantar maklumat promosi atau kemas kini berkaitan servis, Menjalankan analitik dan penilaian prestasi perniagaan, Tujuan audit, pematuhan, dan perundangan, Tujuan keselamatan sistem dan infrastruktur digital.
• RH Empire Legacy tidak menjual, menyewa, atau memperdagangkan DATA PERIBADI pengguna kepada mana-mana pihak ketiga bagi tujuan keuntungan komersial.

6. PERSETUJUAN PENGGUNA

• Dengan menghantar borang, membuat pertanyaan, menggunakan servis, berkomunikasi melalui WhatsApp, telefon, emel, media sosial, atau mana-mana saluran rasmi RH Empire Legacy, pengguna dianggap memberikan persetujuan terhadap pengumpulan, penggunaan, pemprosesan, dan penyimpanan maklumat sebagaimana yang diterangkan dalam Dasar Privasi ini.
• Pengguna juga bersetuju bahawa RH Empire Legacy boleh menghubungi mereka melalui: WhatsApp, Telefon, Emel, SMS, Media sosial, Sistem automasi komunikasi, Saluran komunikasi lain yang munasabah bagi tujuan berkaitan pertanyaan, servis, projek, sokongan pelanggan, pembayaran, kemas kini sistem, pemasaran, promosi, atau komunikasi rasmi yang berkaitan.
• Pengguna boleh menarik balik persetujuan yang diberikan tertakluk kepada keperluan undang-undang, kontrak, audit, rekod kewangan, atau kepentingan sah operasi RH Empire Legacy.

7. PENYIMPANAN DATA & INFRASTRUKTUR DIGITAL

• Bagi tujuan operasi, keselamatan, penyampaian servis, pemprosesan maklumat, pengurusan projek, automasi, dan kesinambungan perkhidmatan, RH Empire Legacy boleh menyimpan atau memproses maklumat melalui pelbagai sistem dan infrastruktur digital.
• Sistem yang digunakan mungkin termasuk tetapi tidak terhad kepada: Cloud Database, Cloud Storage, Firebase, Google Apps Script, Google Workspace, Google Sheets, Sistem CRM, Sistem Automasi, Sistem Pengurusan Projek, Platform Komunikasi, Infrastruktur Pihak Ketiga Yang Berkaitan.
• Pengguna memahami bahawa sebahagian maklumat mungkin disimpan atau diproses melalui pelayar yang berada di dalam atau di luar Malaysia bergantung kepada penyedia teknologi yang digunakan.
• RH Empire Legacy akan mengambil langkah yang munasabah bagi memastikan maklumat yang disimpan atau diproses melalui sistem tersebut dilindungi mengikut amalan keselamatan yang bersesuaian.

8. PEMINDAHAN DATA MERENTAS SEMPADAN

• Dalam keadaan tertentu, DATA PERIBADI mungkin dipindahkan, diproses, disimpan, atau diakses melalui sistem yang beroperasi di luar Malaysia.
• Pemindahan tersebut boleh berlaku apabila RH Empire Legacy menggunakan: Cloud Platform, Web Hosting, Database Service, Analytics Platform, Payment Gateway, API, Sistem Automasi, Penyedia Teknologi Pihak Ketiga.
• Dengan menggunakan servis RH Empire Legacy, pengguna memahami dan bersetuju bahawa pemindahan data sedemikian mungkin berlaku sekiranya diperlukan bagi tujuan operasi dan penyampaian servis.

9. PERKHIDMATAN PIHAK KETIGA

• RH Empire Legacy boleh menggunakan pelbagai penyedia servis pihak ketiga bagi menyokong operasi, pembangunan sistem, komunikasi, pembayaran, pemasaran, keselamatan, analitik, dan automasi.
• Penyedia perkhidmatan tersebut mungkin termasuk tetapi tidak terhad kepada: Web Hosting Provider, Firebase, Google, Meta, TikTok, Fiuu, Curlec, ToyyibPay, Penyedia API, Penyedia Plugin, Penyedia Infrastruktur Awan, Sistem CRM, Platform Komunikasi, Platform Automasi, Platform Analitik.
• RH Empire Legacy hanya berkongsi maklumat yang diperlukan secara munasabah bagi membolehkan penyedia perkhidmatan tersebut melaksanakan fungsi yang berkaitan.
• Walau bagaimanapun, RH Empire Legacy tidak mempunyai kawalan penuh terhadap dasar, operasi, perubahan polisi, atau amalan privasi penyedia perkhidmatan pihak ketiga tersebut. Pengguna digalakkan untuk menyemak dasar privasi pihak ketiga yang berkaitan secara berasingan.

10. PEMBAYARAN & PEMPROSESAN TRANSAKSI

• RH Empire Legacy boleh menerima pembayaran melalui penyedia payment gateway pihak ketiga termasuk tetapi tidak terhad kepada: Fiuu, Curlec, ToyyibPay.
• Semua transaksi pembayaran tertakluk kepada terma, syarat, polisi keselamatan, dan dasar privasi penyedia payment gateway yang digunakan.
• RH Empire Legacy tidak menyimpan nombor kad kredit, nombor kad debit, maklumat perbankan penuh, kod keselamatan kad, atau maklumat pembayaran sensitif pengguna secara langsung dalam sistem milik RH Empire Legacy.
• Sebarang isu berkaitan pemprosesan transaksi, kegagalan pembayaran, gangguan sistem pembayaran, atau kelewatan pemprosesan transaksi yang berpunca daripada penyedia payment gateway adalah tertakluk kepada polisi dan prosedur penyedia perkhidmatan tersebut.

11. AUTOMASI, AI & TEKNOLOGI DIGITAL

• RH Empire Legacy boleh menggunakan sistem automasi, teknologi digital, Artificial Intelligence (AI), machine learning, integrasi API, dan teknologi berkaitan bagi meningkatkan kecekapan operasi serta pengalaman pengguna.
• Teknologi tersebut boleh digunakan bagi tujuan termasuk: Automasi komunikasi, Pengurusan prospek, Pengurusan pelanggan, Analitik data, Penghasilan laporan, Pengurusan projek, Penambahbaikan operasi, Pemantauan prestasi sistem, Sokongan pelanggan.
• RH Empire Legacy akan berusaha memastikan penggunaan teknologi tersebut dilakukan secara bertanggungjawab dan munasabah mengikut keperluan operasi yang sah.

12. KESELAMATAN DATA

• RH Empire Legacy mengambil langkah keselamatan pentadbiran, organisasi, teknikal, dan operasi yang munasabah bagi melindungi DATA PERIBADI daripada: Akses tanpa kebenaran, Penyalahgunaan, Kehilangan data, Kebocoran maklumat, Pendedahan tanpa kebenaran, Perubahan data yang tidak dibenarkan, Kemusnahan data.
• Langkah keselamatan yang digunakan mungkin termasuk: Kawalan akses, Pengesahan pengguna, Sistem log, Kawalan pentadbiran, Perlindungan infrastruktur, Sistem sandaran data, Pemantauan keselamatan.
• Walau bagaimanapun, tiada sistem komputer, rangkaian internet, pelayan, atau platform digital yang boleh dijamin selamat sepenuhnya daripada risiko keselamatan. Oleh itu, pengguna memahami dan mengambil maklum bahawa penggunaan mana-mana servis digital sentiasa melibatkan risiko teknologi yang berada di luar kawalan mutlak mana-mana pihak.

13. PENYIMPANAN & TEMPOH SIMPANAN DATA

• RH Empire Legacy boleh menyimpan DATA PERIBADI selama mana yang diperlukan secara munasabah bagi tujuan: Penyediaan servis, Pengurusan projek, Sokongan pelanggan, Audit dalaman, Rekod transaksi, Rekod kewangan, Pematuhan undang-undang, Penyelesaian pertikaian, Keselamatan sistem, Operasi perniagaan.
• Data yang tidak lagi diperlukan boleh dipadamkan, dinyahaktifkan, dianonimkan, atau dilupuskan mengikut prosedur dalaman RH Empire Legacy.
• Walau bagaimanapun, sesetengah maklumat mungkin terus disimpan sekiranya diperlukan bagi memenuhi keperluan undang-undang, audit, percukaian, rekod kewangan, keselamatan, atau kepentingan sah perniagaan.
• RH Empire Legacy tidak mempunyai kewajipan untuk menyimpan data, fail, rekod, atau maklumat Klien selama-lamanya selepas projek tamat, servis dihentikan, atau hubungan perniagaan berakhir.

14. HAK PENGGUNA

• Tertakluk kepada undang-undang yang terpakai, pengguna mempunyai hak tertentu berhubung DATA PERIBADI mereka yang disimpan atau diproses oleh RH Empire Legacy.
• Hak tersebut mungkin termasuk: Meminta akses kepada data peribadi yang disimpan, Meminta pembetulan maklumat yang tidak tepat, Meminta pengemaskinian maklumat yang tidak lengkap, Menarik balik persetujuan yang telah diberikan, Meminta pemadaman data tertakluk kepada keperluan undang-undang, Mengemukakan pertanyaan berkaitan penggunaan data peribadi.
• Sebarang permintaan hendaklah dibuat melalui saluran komunikasi rasmi RH Empire Legacy. RH Empire Legacy berhak mengambil langkah pengesahan identiti yang munasabah sebelum memproses sebarang permintaan berkaitan data peribadi.

15. PEMBETULAN MAKLUMAT

• RH Empire Legacy berusaha memastikan maklumat yang disimpan adalah tepat, lengkap, dan terkini. Pengguna bertanggungjawab memaklumkan kepada RH Empire Legacy sekiranya berlaku perubahan terhadap maklumat yang diberikan.
• RH Empire Legacy tidak bertanggungjawab terhadap sebarang kesan, kerugian, kelewatan, atau masalah yang berpunca daripada maklumat yang tidak tepat, tidak lengkap, atau tidak dikemas kini oleh pengguna.

16. PERMINTAAN PEMADAMAN DATA

• Pengguna boleh mengemukakan permintaan untuk memadamkan DATA PERIBADI mereka yang disimpan oleh RH Empire Legacy.
• Walau bagaimanapun, permintaan tersebut mungkin tidak dapat dilaksanakan sepenuhnya sekiranya data berkenaan masih diperlukan bagi tujuan: Pematuhan undang-undang, Rekod kewangan, Audit, Percukaian, Penyelesaian pertikaian, Keselamatan sistem, Penguatkuasaan kontrak, Kepentingan sah perniagaan.
• RH Empire Legacy berhak menentukan sama ada sesuatu data perlu dikekalkan berdasarkan keperluan operasi, perundangan, keselamatan, atau pematuhan yang berkaitan.

17. PENARIKAN BALIK PERSETUJUAN

• Pengguna boleh menarik balik persetujuan yang telah diberikan sebelum ini tertakluk kepada keperluan undang-undang dan kewajipan kontrak yang masih berkuat kuasa.
• Penarikan balik persetujuan mungkin menyebabkan sesetengah servis, fungsi, sistem, atau kemudahan yang disediakan oleh RH Empire Legacy tidak lagi dapat digunakan sepenuhnya.
• RH Empire Legacy tidak bertanggungjawab terhadap sebarang gangguan servis, had fungsi, atau ketidakupayaan untuk meneruskan perkhidmatan yang berpunca daripada penarikan balik persetujuan tersebut.

18. PORTFOLIO, RUJUKAN & TESTIMONI

• Kecuali dipersetujui secara bertulis sebaliknya, RH Empire Legacy berhak memaparkan maklumat asas berkaitan projek yang telah disiapkan sebagai sebahagian daripada: Portfolio syarikat, Kajian kes, Bahan pemasaran, Pembentangan profesional, Kandungan promosi, Rujukan perniagaan.
• Maklumat yang dipaparkan akan dihadkan kepada maklumat yang munasabah dan tidak akan mendedahkan maklumat sulit pengguna tanpa kebenaran yang sewajarnya.
• Sebarang testimoni, ulasan, atau maklum balas yang diberikan secara sukarela oleh pengguna boleh digunakan oleh RH Empire Legacy bagi tujuan pemasaran, promosi, atau pembangunan perniagaan kecuali diminta sebaliknya secara bertulis.

19. PENAFIAN & HAD TANGGUNGJAWAB

• RH Empire Legacy mengambil langkah yang munasabah bagi memastikan keselamatan dan integriti maklumat yang dikendalikan. Walau bagaimanapun, RH Empire Legacy tidak memberikan sebarang jaminan bahawa: Sistem akan beroperasi tanpa gangguan, Sistem bebas daripada ralat, Sistem bebas daripada ancaman siber, Sistem bebas daripada akses tanpa kebenaran, Sistem bebas daripada kegagalan teknikal.
• Setakat yang dibenarkan oleh undang-undang, RH Empire Legacy tidak akan bertanggungjawab terhadap: Kerugian tidak langsung, Kehilangan keuntungan, Kehilangan peluang perniagaan, Kehilangan data, Gangguan operasi, Serangan siber, Kerosakan sistem pihak ketiga, Kegagalan infrastruktur luar, Kerosakan yang berada di luar kawalan munasabah RH Empire Legacy.
• Pengguna memahami bahawa penggunaan mana-mana platform digital, internet, atau teknologi sentiasa melibatkan risiko tertentu yang tidak dapat dielakkan sepenuhnya.

20. PERUBAHAN DASAR PRIVASI

• RH Empire Legacy berhak untuk mengubah, mengemas kini, meminda, atau menggantikan mana-mana bahagian dalam Dasar Privasi ini pada bila-bila masa tanpa notis awal.
• Versi terkini Dasar Privasi akan diterbitkan melalui website, platform, sistem, atau saluran rasmi yang berkaitan. Penggunaan berterusan terhadap mana-mana servis selepas pindaan dibuat akan dianggap sebagai penerimaan terhadap versi terkini Dasar Privasi tersebut.

21. UNDANG-UNDANG YANG TERPAKAI

• Dasar Privasi ini hendaklah ditadbir, ditafsirkan, dan dikuatkuasakan mengikut undang-undang Malaysia.
• Sebarang pertikaian, tuntutan, atau prosiding yang timbul berkaitan Dasar Privasi ini hendaklah tertakluk kepada bidang kuasa mahkamah yang kompeten di Malaysia.

Sebarang pertanyaan, aduan, permintaan akses data, pembetulan maklumat, penarikan persetujuan, atau permintaan berkaitan DATA PERIBADI boleh dikemukakan melalui saluran rasmi berikut:

• RH Empire Legacy (“Empire Legacy”, “we”, “us”, or “the company”) respects and is committed to protecting the privacy, confidentiality, and security of all users, visitors, prospects, clients, customers, business partners, and any individual who interacts with the services, website, landing page, web application, systems, digital platforms, customer portals, mobile applications, and related services provided by RH Empire Legacy.

• Identity Card (MyKad) numbers will only be collected where reasonably necessary for identity verification, legal compliance, official documentation, property matters, estate matters, ownership verification, or other purposes permitted by law.

4. TECHNICAL & AUTOMATIC INFORMATION

• When a user browses or uses RH Empire Legacy's platform, certain information may be automatically collected for purposes of security, analytics, system performance, and improving user experience.

• Pembayaran pendahuluan minimum sebanyak 50% diperlukan sebelum kerja dimulakan kecuali dinyatakan sebaliknya secara bertulis.
• Pembayaran pendahuluan dianggap sebagai komitmen rasmi Klien terhadap projek atau servis yang dipersetujui.
• Sebarang kerja pembangunan, konfigurasi, penyelidikan, konsultasi, reka bentuk, pembangunan sistem, atau pelaksanaan hanya akan dimulakan selepas pembayaran diterima sepenuhnya.

4. PENJELASAN PEMBAYARAN

• Baki pembayaran hendaklah dijelaskan sepenuhnya sebelum: Penyerahan projek, Pelancaran sistem, Deployment, Pemindahan akses, Pemindahan kod sumber, Pemindahan fail projek, Penyerahan aset digital, Penyerahan hak milik.
• RH Empire Legacy berhak menangguhkan pelancaran, akses, penyerahan, atau pemindahan projek sekiranya pembayaran penuh belum diterima.

5. POLISI PEMBATALAN & PEMULANGAN WANG

• Sebarang pembayaran pendahuluan adalah tidak boleh dipulangkan sepenuhnya setelah kerja dimulakan.
• Sekiranya pertimbangan pemulangan wang diberikan, jumlah yang dipulangkan akan ditentukan selepas ditolak kos sebenar yang telah ditanggung termasuk tetapi tidak terhad kepada: Domain, Hosting, Plugin, API, Lesen sistem, Servis pihak ketiga, Konsultasi, Kos pembangunan, Kos operasi, Kos tenaga kerja.
• Sebarang permohonan pemulangan wang hendaklah dibuat secara bertulis. Kelulusan pemulangan wang adalah tertakluk sepenuhnya kepada budi bicara RH Empire Legacy.

6. PERUBAHAN SKOP PROJEK

• Sebarang permintaan tambahan di luar skop yang telah dipersetujui akan dianggap sebagai KERJA TAMBAHAN.
• Kerja tambahan mungkin melibatkan: Fungsi baharu, Integrasi baharu, Modul tambahan, Redesign, Perubahan struktur, Perubahan kandungan, Perubahan konsep, Penambahan system.
• RH Empire Legacy berhak mengenakan caj tambahan berdasarkan tahap kerumitan, masa, dan sumber yang diperlukan.

7. TEMPOH MASA PROJEK

• Tempoh pelaksanaan projek yang diberikan adalah anggaran dan tertakluk kepada: Kerumitan projek, Kelulusan Klien, Ketersediaan bahan, Maklum balas Klien, Faktor teknikal, Faktor pihak ketiga.
• Sebarang kelewatan daripada pihak Klien boleh menyebabkan perubahan kepada jadual projek. RH Empire Legacy tidak bertanggungjawab terhadap kelewatan yang berpunca daripada kegagalan Klien memberikan bahan, maklumat, akses, atau kelulusan yang diperlukan.

8. TANGGUNGJAWAB KLIEN

• Klien bertanggungjawab memastikan semua maklumat, kandungan, dokumen, gambar, video, logo, data, dan bahan yang diberikan kepada RH Empire Legacy adalah sah serta mempunyai kebenaran penggunaan yang sewajarnya.
• Klien bertanggungjawab terhadap ketepatan semua maklumat yang diberikan. RH Empire Legacy tidak bertanggungjawab terhadap sebarang tuntutan, kerugian, atau pertikaian yang timbul akibat kandungan yang dibekalkan oleh Klien.

9. PROJEK ON HOLD & KELEWATAN KLIEN

• Klien bertanggungjawab menyediakan semua maklumat, kandungan, dokumen, bahan media, akses sistem, dan kelulusan yang diperlukan bagi membolehkan projek dilaksanakan mengikut jadual yang dipersetujui.
• Sekiranya Klien gagal memberikan maklum balas, bahan, akses, atau komunikasi selama lebih daripada 30 hari berturut-turut, RH Empire Legacy berhak mengklasifikasikan projek tersebut sebagai ON HOLD.
• RH Empire Legacy berhak menyusun semula jadual kerja dan keutamaan projek selepas projek yang ditangguhkan disambung semula. Caj tambahan atau REACTIVATION FEE boleh dikenakan bagi mengaktifkan semula projek yang telah ditangguhkan.

10. KLIEN TIDAK MEMBERI MAKLUM BALAS (GHOSTING)

• Sekiranya Klien gagal memberikan maklum balas dalam tempoh yang munasabah, RH Empire Legacy tidak akan dipertanggungjawabkan terhadap sebarang kelewatan projek yang berlaku.
• Sebarang tempoh kelewatan yang berpunca daripada kegagalan komunikasi Klien tidak akan dianggap sebagai kelewatan daripada pihak RH Empire Legacy. RH Empire Legacy berhak menangguhkan projek sehingga maklumat atau maklum balas yang diperlukan diterima.

11. AKSES, PENYERAHAN & PELANCARAN

• Sebarang akses sementara, akses percubaan, akses pentadbiran, akses pengguna, atau akses sistem yang diberikan sebelum pembayaran penuh tidak boleh dianggap sebagai penyerahan rasmi projek.
• RH Empire Legacy berhak menggantung, mengehadkan, atau menarik semula akses tersebut sekiranya pembayaran belum diselesaikan sepenuhnya.
• Penyerahan rasmi projek hanya dianggap berlaku selepas pembayaran penuh diterima dan pengesahan penyerahan dibuat oleh RH Empire Legacy.

12. HAK CIPTA & HAK MILIK

• Semua konsep, strategi, cadangan, struktur sistem, wireframe, layout, mockup, reka bentuk, dokumentasi, kod sumber, automasi, sistem, proses, dan bahan yang dibangunkan oleh RH Empire Legacy kekal menjadi hak milik RH Empire Legacy sehingga pembayaran penuh diterima.
• Klien tidak dibenarkan menggunakan, menyalin, mengubah suai, menjual, mengedar, atau menyerahkan mana-mana bahan tersebut kepada pihak lain tanpa kebenaran bertulis daripada RH Empire Legacy.
• Hak milik penuh hanya akan dipindahkan selepas semua pembayaran berjaya dijelaskan sepenuhnya. Sebarang penggunaan tanpa kebenaran boleh menyebabkan tindakan undang-undang diambil.

13. DOMAIN, HOSTING & PERKHIDMATAN PIHAK KETIGA

• Domain, hosting, API, plugin, sistem pembayaran, integrasi pihak ketiga, dan teknologi luar adalah tertakluk kepada polisi, harga, syarat, dan perubahan yang ditetapkan oleh penyedia masing-masing.
• RH Empire Legacy tidak mempunyai kawalan terhadap perubahan polisi, harga, limitasi teknikal, atau penamatan servis oleh mana-mana penyedia pihak ketiga.
• RH Empire Legacy tidak bertanggungjawab terhadap: Kenaikan harga, Perubahan polisi, Kehilangan akses, Gangguan sistem, Downtime, Penamatan akaun, Kerosakan sistem pihak ketiga, Kehilangan data akibat kegagalan pihak ketiga.
• Domain yang didaftarkan menggunakan maklumat Klien akan menjadi hak milik Klien tertakluk kepada polisi pendaftar domain yang berkaitan.

14. PEMBAHARUAN DOMAIN, HOSTING & LANGGANAN

• Klien bertanggungjawab memastikan semua pembaharuan domain, hosting, lesen sistem, plugin, API, dan perkhidmatan langganan dibuat sebelum tarikh tamat tempoh.
• RH Empire Legacy tidak bertanggungjawab terhadap kehilangan akses, gangguan operasi, kehilangan data, atau kerugian yang berpunca daripada kegagalan pembaharuan tersebut.
• Sebarang bantuan pembaharuan yang diberikan oleh RH Empire Legacy tidak memindahkan tanggungjawab pembaharuan kepada RH Empire Legacy.

15. MAINTENANCE & SOKONGAN

• Kecuali dinyatakan secara bertulis, servis berikut tidak termasuk dalam skop asal projek: Maintenance, Pemantauan sistem, Kemas kini sistem, Backup, Pengurusan keselamatan, Sokongan teknikal berterusan, Pengurusan kandungan.
• Perkhidmatan tersebut hanya akan diberikan melalui pelan penyelenggaraan atau perjanjian berasingan. RH Empire Legacy tidak bertanggungjawab terhadap sebarang isu selepas penyerahan projek sekiranya Klien tidak melanggan pelan penyelenggaraan yang aktif.

16. PENGUBAHSUAIAN OLEH KLIEN

• Sebarang pengubahsuaian yang dibuat oleh Klien atau pihak ketiga selepas projek diserahkan adalah di bawah tanggungjawab Klien sepenuhnya.
• RH Empire Legacy tidak bertanggungjawab terhadap: Kerosakan sistem, Kehilangan data, Masalah keselamatan, Ketidakserasian sistem, Kerosakan fungsi, Gangguan operasi yang berlaku selepas pengubahsuaian tersebut dibuat.

17. AI, AUTOMASI & TEKNOLOGI DIGITAL

• RH Empire Legacy boleh menggunakan teknologi Artificial Intelligence (AI), sistem automasi, integrasi API, atau teknologi digital lain bagi membantu proses penyelidikan, pembangunan, reka bentuk, dokumentasi, analisis, pengujian, dan pelaksanaan projek.
• Penggunaan teknologi tersebut adalah sebahagian daripada proses operasi dalaman RH Empire Legacy bagi meningkatkan kecekapan, produktiviti, dan kualiti penyampaian perkhidmatan. Klien memahami bahawa penggunaan teknologi tersebut tidak menjejaskan hak atau kewajipan mana-mana pihak di bawah perjanjian ini.

18. PORTFOLIO & RUJUKAN

• Kecuali dipersetujui secara bertulis sebaliknya, RH Empire Legacy berhak memaparkan projek yang telah siap sebagai: Portfolio, Kajian kes, Rujukan profesional, Bahan pemasaran, Pembentangan syarikat, Kandungan promosi.
• RH Empire Legacy tidak akan mendedahkan maklumat sulit Klien tanpa kebenaran yang sewajarnya.

19. NON-SOLICITATION

• Sepanjang tempoh projek dan selama 12 bulan selepas projek tamat, Klien tidak dibenarkan secara langsung atau tidak langsung menawarkan pekerjaan, kontrak, kerjasama, atau perkhidmatan kepada mana-mana pekerja, kontraktor, perunding, atau rakan strategik RH Empire Legacy tanpa kebenaran bertulis daripada RH Empire Legacy.
• Sebarang pelanggaran terhadap klausa ini boleh menyebabkan tindakan undang-undang dan tuntutan ganti rugi yang munasabah.

20. HAD MAKSIMUM TANGGUNGJAWAB

• Walau apa pun yang dinyatakan dalam mana-mana dokumen atau komunikasi lain, jumlah maksimum tanggungjawab RH Empire Legacy bagi sebarang tuntutan berkaitan projek adalah terhad kepada 100% daripada jumlah bayaran yang telah diterima oleh RH Empire Legacy bagi projek tersebut.
• RH Empire Legacy tidak akan bertanggungjawab terhadap: Kerugian tidak langsung, Kehilangan keuntungan, Kehilangan peluang perniagaan, Kehilangan pelanggan, Kehilangan data, Kerosakan reputasi, Gangguan operasi, Kerugian khas, Kerugian sampingan yang timbul secara langsung atau tidak langsung daripada penggunaan atau kegagalan penggunaan mana-mana sistem, servis, atau projek yang dibangunkan.

21. FORCE MAJEURE

• RH Empire Legacy tidak akan dianggap melanggar mana-mana kewajipan sekiranya kelewatan atau kegagalan melaksanakan servis berpunca daripada keadaan di luar kawalan munasabah termasuk tetapi tidak terhad kepada: Bencana alam, Kebakaran, Banjir, Gempa bumi, Gangguan internet, Serangan siber, Kegagalan pusat data, Gangguan penyedia servis, Tindakan kerajaan, Peperangan, Rusuhan, Pandemik, Kecemasan nasional.

22. PERUBAHAN TERMA & SYARAT

• RH Empire Legacy berhak mengubah, meminda, mengemas kini, atau menggantikan mana-mana bahagian dalam Terma & Syarat ini pada bila-bila masa. Versi terkini akan menggantikan semua versi terdahulu dan akan berkuat kuasa sebaik sahaja diterbitkan.

23. UNDANG-UNDANG YANG TERPAKAI

• Terma & Syarat ini ditadbir, ditafsirkan, dan dikuatkuasakan mengikut undang-undang Malaysia. Sebarang pertikaian, tuntutan, atau prosiding yang timbul berkaitan Terma & Syarat ini hendaklah tertakluk kepada bidang kuasa eksklusif mahkamah yang kompeten di Malaysia.

24. KEBOLEHAN PELAKSANAAN KLAUSA

• Sekiranya mana-mana klausa dalam Terma & Syarat ini didapati tidak sah, tidak boleh dikuatkuasakan, atau bercanggah dengan undang-undang yang terpakai, klausa tersebut hendaklah dipisahkan tanpa menjejaskan kesahan dan penguatkuasaan klausa-klausa yang lain.

25. PERSETUJUAN & PENERIMAAN

• Dengan menerima quotation, membuat pembayaran, menandatangani dokumen, membalas persetujuan bertulis, atau menggunakan mana-mana servis RH Empire Legacy, Klien dianggap telah membaca, memahami, dan bersetuju dengan semua Terma & Syarat ini.
• Klien juga mengakui bahawa mereka telah diberikan peluang yang munasabah untuk membaca, memahami, dan mendapatkan penjelasan berkaitan dokumen ini sebelum meneruskan penggunaan servis RH Empire Legacy.

RH EMPIRE LEGACY - TERMS & CONDITIONS

Effective Date: 04/04/2026

1. AGREEMENT TO SERVICE

• These Terms & Conditions govern the use of all services, products, systems, platforms, consultation, and services provided by RH Empire Legacy (“Empire Legacy”, “we”, “us”, or “the company”).
• By accepting a quotation, making payment, signing a document, providing written confirmation, or continuing to use our services, the Client is deemed to have read, understood, and agreed to all terms contained in this document.
• These Terms & Conditions shall be read together with the PRIVACY POLICY, PERSONAL DATA PROTECTION NOTICE (PDPA Notice), COOKIE POLICY, DISCLAIMER, and any other related documents issued by RH Empire Legacy.

2. SCOPE OF SERVICES

• RH Empire Legacy provides services including but not limited to: website development, landing page development, web application development, mobile application development, SaaS systems, automation systems, API integration, branding, graphic design, digital marketing, digital consultation, real estate consultation, estate planning, financial consultation, and related technology and business services.
• The actual scope of a project is based on the quotation, project proposal, invoice, written document, or agreement agreed between RH Empire Legacy and the Client.

3. ADVANCE PAYMENT

• A minimum advance payment of 50% is required before work begins unless otherwise agreed in writing.
• Advance payment is deemed the Client's formal commitment to the agreed project or service.
• Any development work, configuration, research, consultation, design, system development, or implementation will only commence after payment has been received in full.

4. PAYMENT SETTLEMENT

• The remaining balance must be settled in full before: project handover, system launch, deployment, access transfer, source code transfer, project file transfer, digital asset handover, or transfer of ownership.
• RH Empire Legacy reserves the right to delay the launch, access, handover, or transfer of a project should full payment not yet be received.

5. CANCELLATION & REFUND POLICY

• Any advance payment is non-refundable in full once work has commenced.
• Should a refund be considered, the amount refunded will be determined after deducting actual costs incurred, including but not limited to: domain, hosting, plugins, APIs, system licences, third-party services, consultation, development costs, operational costs, and labour costs.
• Any refund request must be made in writing. Approval of a refund is entirely at RH Empire Legacy's discretion.

6. CHANGES TO PROJECT SCOPE

• Any additional request outside the agreed scope will be deemed ADDITIONAL WORK.
• Additional work may involve: new functions, new integrations, additional modules, redesign, structural changes, content changes, concept changes, or additional systems.
• RH Empire Legacy reserves the right to impose additional charges based on the level of complexity, time, and resources required.

7. PROJECT TIMELINE

• The project timeline given is an estimate and is subject to: project complexity, Client approval, availability of materials, Client feedback, technical factors, and third-party factors.
• Any delay caused by the Client may result in changes to the project schedule. RH Empire Legacy shall not be responsible for delays caused by the Client's failure to provide required materials, information, access, or approval.

8. CLIENT RESPONSIBILITIES

• The Client is responsible for ensuring that all information, content, documents, images, videos, logos, data, and materials provided to RH Empire Legacy are valid and have the proper usage rights.
• The Client is responsible for the accuracy of all information provided. RH Empire Legacy shall not be responsible for any claim, loss, or dispute arising from content supplied by the Client.

9. PROJECTS ON HOLD & CLIENT DELAY

• The Client is responsible for providing all information, content, documents, media materials, system access, and approvals required to enable the project to proceed according to the agreed schedule.
• Should the Client fail to provide feedback, materials, access, or communication for more than 30 consecutive days, RH Empire Legacy reserves the right to classify the project as ON HOLD.
• RH Empire Legacy reserves the right to reschedule work and reprioritise the project after a delayed project resumes. An additional charge or REACTIVATION FEE may be imposed to reactivate a project that has been placed on hold.

10. CLIENT NON-RESPONSIVENESS (GHOSTING)

• Should the Client fail to provide feedback within a reasonable period, RH Empire Legacy shall not be held responsible for any resulting project delay.
• Any delay period caused by the Client's failure to communicate shall not be deemed a delay on the part of RH Empire Legacy. RH Empire Legacy reserves the right to suspend the project until the required information or feedback is received.

11. ACCESS, HANDOVER & LAUNCH

• Any temporary access, trial access, administrative access, user access, or system access granted before full payment shall not be deemed an official project handover.
• RH Empire Legacy reserves the right to suspend, restrict, or revoke such access should payment not be fully settled.
• Official project handover is only deemed to occur after full payment is received and handover confirmation is made by RH Empire Legacy.

12. COPYRIGHT & OWNERSHIP

• All concepts, strategies, recommendations, system structures, wireframes, layouts, mockups, designs, documentation, source code, automation, systems, processes, and materials developed by RH Empire Legacy remain the property of RH Empire Legacy until full payment is received.
• The Client is not permitted to use, copy, modify, sell, distribute, or hand over any such materials to another party without written permission from RH Empire Legacy.
• Full ownership will only be transferred after all payments have been fully settled. Any unauthorised use may result in legal action being taken.

13. DOMAIN, HOSTING & THIRD-PARTY SERVICES

• Domain, hosting, API, plugins, payment systems, third-party integrations, and external technology are subject to the policies, pricing, terms, and changes set by their respective providers.
• RH Empire Legacy has no control over policy changes, pricing, technical limitations, or termination of service by any third-party provider.
• RH Empire Legacy shall not be responsible for: price increases, policy changes, loss of access, system disruption, downtime, account termination, third-party system failure, or data loss caused by third-party failure.
• A domain registered using the Client's information will become the Client's property, subject to the policies of the relevant domain registrar.

14. RENEWAL OF DOMAIN, HOSTING & SUBSCRIPTIONS

• The Client is responsible for ensuring all renewals of domain, hosting, system licences, plugins, APIs, and subscription services are made before their expiry date.
• RH Empire Legacy shall not be responsible for loss of access, operational disruption, data loss, or losses arising from failure to renew such services.
• Any renewal assistance provided by RH Empire Legacy does not transfer the responsibility for renewal to RH Empire Legacy.

15. MAINTENANCE & SUPPORT

• Unless stated in writing, the following services are not included within the original project scope: maintenance, system monitoring, system updates, backup, security management, ongoing technical support, and content management.
• Such services will only be provided through a maintenance plan or separate agreement. RH Empire Legacy shall not be responsible for any issue after project handover should the Client not subscribe to an active maintenance plan.

16. MODIFICATIONS BY THE CLIENT

• Any modification made by the Client or a third party after project handover is entirely the Client's responsibility.
• RH Empire Legacy shall not be responsible for: system damage, data loss, security issues, system incompatibility, functional damage, or operational disruption occurring after such modification is made.

17. AI, AUTOMATION & DIGITAL TECHNOLOGY

• RH Empire Legacy may use Artificial Intelligence (AI) technology, automation systems, API integrations, or other digital technology to assist with research, development, design, documentation, analysis, testing, and project implementation.
• The use of such technology forms part of RH Empire Legacy's internal operational process to improve efficiency, productivity, and quality of service delivery. The Client understands that the use of such technology does not affect the rights or obligations of any party under this agreement.

18. PORTFOLIO & REFERENCES

• Unless otherwise agreed in writing, RH Empire Legacy reserves the right to display completed projects as: a portfolio, case study, professional reference, marketing material, company presentation, or promotional content.
• RH Empire Legacy will not disclose the Client's confidential information without proper authorisation.

19. NON-SOLICITATION

• Throughout the project period and for 12 months after the project ends, the Client is not permitted, directly or indirectly, to offer employment, contract, cooperation, or services to any employee, contractor, consultant, or strategic partner of RH Empire Legacy without written permission from RH Empire Legacy.
• Any breach of this clause may result in legal action and a claim for reasonable damages.

20. MAXIMUM LIMITATION OF LIABILITY

• Notwithstanding anything stated in any other document or communication, the maximum liability of RH Empire Legacy for any claim relating to a project is limited to 100% of the total amount of payment received by RH Empire Legacy for that project.
• RH Empire Legacy shall not be liable for: indirect losses, loss of profit, loss of business opportunity, loss of customers, data loss, reputational damage, operational disruption, special losses, or consequential losses arising directly or indirectly from the use or failure to use any system, service, or project developed.

21. FORCE MAJEURE

• RH Empire Legacy shall not be deemed to be in breach of any obligation where a delay or failure to perform a service arises from circumstances beyond reasonable control, including but not limited to: natural disasters, fire, flood, earthquake, internet disruption, cyberattacks, data centre failure, service provider disruption, government action, war, riots, pandemics, or national emergencies.

22. CHANGES TO TERMS & CONDITIONS

• RH Empire Legacy reserves the right to change, amend, update, or replace any part of these Terms & Conditions at any time. The latest version shall supersede all previous versions and shall take effect immediately upon publication.

23. GOVERNING LAW

• These Terms & Conditions are governed, interpreted, and enforced in accordance with the laws of Malaysia. Any dispute, claim, or proceeding arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the competent courts of Malaysia.

24. SEVERABILITY

• Should any clause in these Terms & Conditions be found invalid, unenforceable, or in conflict with applicable law, that clause shall be severed without affecting the validity and enforceability of the remaining clauses.

25. CONSENT & ACCEPTANCE

• By accepting a quotation, making payment, signing a document, replying with written consent, or using any service of RH Empire Legacy, the Client is deemed to have read, understood, and agreed to all of these Terms & Conditions.
• The Client also acknowledges that they have been given a reasonable opportunity to read, understand, and seek clarification regarding this document before continuing to use RH Empire Legacy's services.
